Section 1
Agreement and operator
These Terms of Use are an agreement between you and Bates Punta Cana Social Group SRL, operator of Punta Cana Project in Punta Cana, Dominican Republic. By browsing, registering, submitting content, reserving an event, or using the platform, you agree to these terms and the policies linked below. If you do not agree, do not use the platform.
Section 2
Eligibility and accounts
You must be at least 18 to create an account, purchase or reserve an event independently, register a business, or act as event staff. You must provide accurate information, keep credentials confidential, and promptly update your details.
Accounts are personal unless expressly created for an approved business or event staff role. You may not share a staff login with unauthorized people, evade approval controls, impersonate another person, or create accounts for abusive or fraudulent purposes.
Section 3
Events, availability, and organizers
Listings may be created by Punta Cana Project or approved organizers. Dates, locations, hosts, availability, age limits, accessibility, inclusions, and other details may change. A free RSVP records interest or a reservation; a paid ticket is confirmed only after successful payment and confirmation.
Organizers remain responsible for delivering their events and for venue-specific requirements. Punta Cana Project may correct a listing, limit availability, refuse or cancel a reservation, or remove an event where reasonably necessary for safety, accuracy, fraud prevention, or compliance.
Section 4
Paid tickets and PayPal
Prices, currency, quantities, and material event terms are shown before checkout. Payments are processed by PayPal under PayPal’s terms and privacy notice. We do not store full card or bank-account details.
A pending or failed payment does not create a paid ticket. Do not submit a second payment if a result is unclear; check your reservation status or contact us first. Refunds and cancellations are governed by the event listing and our Refund & Cancellation Policy.
Section 5
QR passes and check-in
Paid confirmations may include a QR pass, confirmation reference, and single-use check-in code. Keep them secure. Authorized staff may scan the QR code or enter the code manually. Once validly checked in, the pass is marked used and cannot be reused. Copying, reselling, altering, or attempting to reuse a pass may result in refusal of entry or account action.
Section 6
Community conduct and safety
You agree to act lawfully and respectfully. You may not harass, threaten, discriminate, spam, deceive, interfere with the service, scrape data without permission, upload malware, infringe rights, promote unlawful activity, or misuse contact information obtained through the platform.
Events may involve travel, water, exercise, nightlife, alcohol, weather, or other inherent risks. Review event details, follow staff and venue instructions, disclose relevant needs directly to the organizer, and use your judgment. Nothing in these terms excludes rights or responsibilities that cannot lawfully be excluded.
Section 7
Business listings, offers, and affiliate links
Business representatives must be authorized to act for the business and must keep public details, locations, prices, member offers, promotional codes, availability, and links accurate. Businesses are responsible for honoring active offers as displayed and for their goods, services, staff, licenses, taxes, and customer relationships.
Approval, featured placement, membership, or display on Punta Cana Project is not an endorsement or guarantee. Affiliate or sponsored relationships should be disclosed where applicable. We may edit formatting, request evidence, suspend an offer, or remove a listing that is inaccurate, unsafe, expired, unlawful, or inconsistent with platform standards.
Section 8
Content, reviews, and intellectual property
You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that content as needed to operate and promote the platform, listing, business, or event, until it is removed, subject to reasonable backup and archival periods.
You confirm that you have the rights and permissions needed for submitted text, logos, photos, videos, reviews, and personal information. Reviews must reflect genuine experiences. Our name, branding, design, software, and original content remain owned by us or our licensors and may not be copied or commercially reused without permission.
Section 9
Third-party services and links
The platform may link to PayPal, OpenStreetMap, directions, Instagram, WhatsApp, business websites, or other services. Those services are independently operated and their terms and privacy practices apply. We are not responsible for third-party websites, availability, content, or transactions outside Punta Cana Project.
Section 10
Platform availability and disclaimers
We aim to keep information and services available and accurate, but the platform is provided on an “as available” basis. We do not promise uninterrupted operation, error-free content, a particular event outcome, attendance level, business result, personal connection, or suitability of a third-party service. We may maintain, change, suspend, or discontinue features.
Section 11
Responsibility and limits
To the fullest extent permitted by applicable law, Punta Cana Project is not liable for indirect, incidental, special, or consequential loss arising from third-party conduct, event changes, venue conditions, business services, unauthorized pass use, or external services. Any limitation applies only where lawful and does not restrict mandatory consumer rights, liability for fraud, or other liability that cannot legally be limited.
Section 12
Suspension and termination
You may stop using the platform or request account closure. We may restrict, suspend, or terminate access, cancel affected reservations where appropriate, and preserve relevant records if we reasonably believe there is fraud, abuse, unsafe conduct, repeated rule violations, legal risk, or a threat to the platform or community. Payment and refund obligations that arose earlier survive termination.
Section 13
Governing law, changes, and contact
These terms are governed by the laws of the Dominican Republic, without removing consumer protections that apply where you live. Courts with lawful jurisdiction in the Dominican Republic may hear disputes unless mandatory law requires otherwise. We may update these terms and will post a new effective date, with additional notice for material changes. Contact info@puntacanaproject.com with questions.
